Terms Of Service (TOS)



Domains Extreme wishes to provide its customers with quality web hosting services. To accomplish this, all customers need to follow some rules and guidelines. These policies are intended to maintain Domains Extreme's high quality level of services and make them available to all of its customers on a fair, consistent and efficient basis.

The use of Domains Extreme's services immediately constitutes acceptance and acknowledgment of these Terms of Service, any applicable domain name registration agreements and all policies and guidelines.

Domains Extreme reserves the right to modify its terms and conditions at any time and from time to time in its sole discretion and the modifications would be effective as soon as they are updated in this document. Domains Extreme reserves the right to terminate or interrupt any account, in part or in full, without refund for violation of these terms. In case of any dispute, resolution will be handled on an individual basis at Domains Extreme's sole discretion.

 

Account Setup / User Contact Details

We will setup your account after we have received the payment and your order has been screened for fraud. It is your responsibility to provide us with a valid and functional email address which is not at the domain(s) you are signing up under.

Any further correspondence with you would be carried out on the email address in our records and all administrative requests for your domain would be entertained only if they are through your default email address.

 

Web Site Content

Domains Extreme is not obligated to monitor the network for the purpose of examining customer's content including but not limited to electronic mail transmission, mailing lists, news groups or other material created or accessible over Domains Extreme's servers. You hereby acknowledge that if we are made aware of content that is determined to be, in Domains Extreme's sole discretion, unacceptable, undesirable, offensive, indecent, obscene, excessively violent or otherwise objectionable, Domains Extreme has the right, but not the obligation, to edit, remove or deny access to such content. Domains Extreme may disclose any content or records concerning customer's account as required to satisfy any legal requirement, regulation, government request or court order.

Non-acceptable content or links include but are not necessarily be limited to:

  • Adult Content - Any erotic or pornographic material, links to adult sites, or advertisements for adult sites.
  • Pirated Softwares (Warez) - Any software that is copyrighted and not freely available for distribution without cost; i.e. ROMs, ROM Emulators and MPEG Layer 3 files (MP3).
  • Copyright Violations - Violation of copyrights held by individuals and corporations or other entities can result in civil and criminal liability for the infringer.
  • Hacking/Phreaking - Includes sites with material, links, or resources for hacking, phreaking, viruses, anarchy, or any type of site that promotes or participates in willful harm to Internet sites or providers.
  • IRC Bots/Eggdrops – IRC Bots or any other automation programs used specifically in conjunction with IRC are not allowed.

 

SPAM / Unsolicited Emails

You or accounts under you must not use Domains Extreme's network, equipment or any email address in connection with the transmission of spam, flames, mail bombs, or substantially similar, unsolicited email messages. When any customer is found to have been engaged in spamming, Domains Extreme reserves the right to disable that customer's web site without any warning and/or cancel the services without any refund. In addition, Domains Extreme may impose a PKR 2000 penalty for each spam policy violation.

Domains Extreme solely reserves the right to refuse or cancel the service to spammers, at its sole discretion.

 

System Security

Customers may not use the Domains Extreme Networks to attempt in any way to circumvent user authentication or security of any host, network, or account. This includes, but is not limited to, accessing any data not intended for the customer, logging into any server or account the customer is not expressly uthorized to access, password cracking, probing the security of other networks in search of weakness, or violation of any other organization's security policy. Customers may not attempt to interfere or deny service to any user, host, or network. This includes, but is not limited to, flooding, mail bombing, or other deliberate attempts to overload or crash a host or network. Domains Extreme will cooperate fully with investigations of violations of systems or network security at other sites, including cooperating with law enforcement authorities in the investigation of suspected criminal violations. Users who violate system or network security may incur criminal or civil liability.

 

Account Cancellation, Money Back Guarantee, Refunds & Upgrades

Domain Registration:
All domain fees are non-refundable once the domain has been registered/transferred/renewed. The registrant is totally responsible for any spelling mistake ccurred by him during the signup process. Once registered, the domain registration can not be reversed and Domains Extreme will not be liable to refund the fees.

Web Hosting Services:
Each of Domains Extreme's shared and reseller packages carry a 15 day unconditional money back guarantee on them. If you are not completely satisfied with our services within the first 15 days of your service, you will be given a full refund. In case a free domain is given with any package, the domain fee, equal to the fee mentioned on Domains Extreme's website, would be deducted from the refund. After 15 days no refunds are provided. However, cancellation due to violation of the Terms of Service will waive the refund policy even within the first 15 days.

In case of hosting package upgrades, you will be credited on a prorated basis of any unused time of the previous package. Your package would be upgraded once the difference in the new package fee and the old package credit is paid.

The following methods of payments are non-refundable, and refunds will be posted as credit to the hosting account:

  • Bank Wire Transfers
  • Western Union Payments
  • Checks
  • Money Orders

99.9% Uptime Guarantee

If your shared / reseller server has a physical downtime that is not within the 99.9% limit you may receive one month of credit on your account. Approval of the credit is at the discretion of Domains Extreme dependant upon justification provided. Third party monitoring service reports may not be used for justification due to a variety of factors including the monitor's network capacity/transit availability. The uptime of the server is defined as the reported uptime from the operating system and the Apache Web Server which may differ from the uptime reported by other individual services. To request a credit, please contact the Sales Department with a valid justification.

 

Payment Information & Late Fee

You are required to supply appropriate payment for the services received from Domains Extreme, in advance of the time period during which such services are provided. It is your responsibility to ensure that your payment information is up to date, and that all invoices are paid on time. Domains Extreme provides a 10 day grace period from the time the invoice is due and when it must be paid.

Any invoice that is overdue for 10 days and not paid will result in a PKR 200 late fee and/or an account suspension until account balance has been paid in full.

For domain names, any domain(s) that are not paid within one month of registration/renewal are transferred in favor of Domains Extreme. In such a case, the ownership of domain can be reclaimed by paying the ownership reclamation fee of amount up to 5 times the cost of registering a domain, which shall be decided upon by Domains Extreme in its sole discretion.

Domains Extreme reserves the right to change their package pricing and any other charges at any time with or without any notice.

 

Excessive Resource Usage

Each hosting account has an agreed amount of monthly bandwidth limit which varies depending on the hosting package you purchase. Bandwidth is the amount of data transmitted to and from your account (E-mail, Shell, Website, FTP). Domains Extreme will make available the bandwidth utilization of each website via customer control panel. Should your account pass the allocated amount, Domains Extreme reserves the right to suspend the account until the start of the next allocation or until either more bandwidth is purchased at an additional fee or you upgrade to a higher level of package.
 
Any web site that uses an excessively high amount of server resources including but not limited to CPU time and memory will be given an option of either upgrading their service level or reducing the resource used to an acceptable level. This policy is only implemented in extreme circumstances and is intended to prevent the misuse of our servers.

 

Backups & Data Loss

Your use of the service is at your sole risk. Domains Extreme is not responsible for files and/or data residing on your account. You agree to take full responsibility for files and data transferred and to maintain all appropriate backup of files and data stored on Domains Extreme's servers. However, we provide weekly backups of your hosting account which can be obtained in case of need.

 

Warranties/Disclaimer

Domains Extreme will not be responsible for any damages your business may suffer and makes no warranties of any kind, expressed or implied for services we provide. Domains Extreme disclaims any warranty or merchantability or fitness for a particular purpose including data loss resulting from delays, non-deliveries, wrong delivery, and any and all service interruptions of any kind caused by Domains Extreme and its employees.

 

Limited Liabilities

You agree that you will protect, indemnify, save and hold Domains Extreme, harmless from any and all stipulations, liabilities, losses, expenses and claims, as well as reasonable legal fees assessed against Domains Extreme, its agents, customers, officers, employees and administration that may arise or result from any service provided or performed or agreed to be performed or any product sold by you, your agents, employees or assigns. You agree to defend, indemnify and hold Domains Extreme, harmless against liabilities arising out of:

  • Any injury to person or property caused by any products sold or distributed in association with Domains Extreme Services;
  • Any material furnished by you infringing or allegedly infringing on the proprietary rights of a third party;
  • Copyright violation and any defective products sold to a customer from Domains Extreme Servers.
